These Terms of Service ("Terms") constitute a legally binding agreement between you and employkids ("we," "our," or "us"). By accessing or using the employkids website and services (collectively, the "Service"), you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years of age.

2. Description of Service

employkids is a record-keeping and documentation platform that helps parents maintain proper employment records for legitimate work performed by their minor children. The Service provides:

  • Employment agreement templates and generation
  • Work logging and hour tracking tools
  • Payment tracking and documentation
  • Tax worksheet generation (W-2 worksheets, payroll data for tax filing)
  • Record-keeping for audit purposes
  • Year-end tax packet compilation

Important: employkids generates tax worksheets and documentation only. We do not file tax forms with the IRS, SSA, or any government agency on your behalf. You or your tax professional are solely responsible for filing all required tax forms and ensuring compliance with applicable laws.

3. Not Tax, Legal, or Financial Advice

IMPORTANT DISCLAIMER: employkids is a record-keeping tool only. We do not provide tax, legal, financial, or investment advice. We do not serve as a fiduciary, broker-dealer, registered investment advisor, tax preparer, or attorney. The information provided through the Service is for general informational purposes only and should not be construed as professional advice.

The Service does not guarantee any particular tax outcome, IRS audit result, or financial benefit. Tax laws are complex, vary by jurisdiction, and change frequently. The applicability of FICA exemptions, business deductions, and other tax benefits depends on your specific situation, business structure, and compliance with applicable laws.

You should consult a qualified CPA, tax attorney, or other licensed professional before making any tax, legal, or financial decisions. We strongly recommend working with a tax professional who can evaluate your specific circumstances.

4. User Responsibilities

You are solely responsible for:

  • Ensuring all work logged is legitimate, age-appropriate, and actually performed by your child
  • Setting fair and reasonable compensation rates appropriate for the type of work and your child's age
  • Complying with all applicable federal, state, and local laws regarding child labor, employment, and taxation
  • Filing accurate tax returns and paying all taxes owed
  • Verifying the accuracy of all information entered into the Service
  • Maintaining appropriate supervision of your child during work activities
  • Actually paying your child the wages documented in the Service
  • Maintaining your own backup copies of important records

5. Acceptable Use

You agree not to use the Service to:

  • Create false, fraudulent, or misleading records
  • Document work that was not actually performed
  • Evade taxes or engage in tax fraud
  • Violate child labor laws or exploit children
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service for any illegal purpose
  • Resell, sublicense, or commercially exploit the Service without authorization

We reserve the right to suspend or terminate your account if we reasonably believe you are violating these Terms or using the Service for fraudulent purposes.

6. Subscription and Payment

The Service is offered on an annual subscription basis. Current pricing is available on our website. By subscribing, you authorize us to charge your payment method for the subscription fee. All fees are in U.S. dollars.

Automatic Renewal: Subscriptions automatically renew at the end of each subscription period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us.

30-Day Money-Back Guarantee: If you are not satisfied with the Service within 30 days of your initial purchase, you may request a full refund by contacting us at hello@employkids.com. This guarantee applies to initial purchases only, not to subscription renewals.

Refunds: Except for the 30-day money-back guarantee, subscription fees are non-refundable. If you cancel your subscription, you will retain access to the Service until the end of your current billing period.

7. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Use a strong, unique password for your account
  • Not share your account credentials with others
  • Notify us immediately of any unauthorized use of your account
  • Log out of your account when using shared devices

We are not liable for any loss or damage arising from your failure to protect your account credentials.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

9. Intellectual Property

The Service and its original content, features, functionality, and design are owned by employkids and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

You retain ownership of all data and content you enter into the Service. By using the Service, you grant us a limited license to use, process, and store your data solely for the purpose of providing the Service to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or servers are free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.

We make no representations or warranties regarding the tax treatment of any wages, deductions, or contributions documented through the Service. Tax outcomes depend on your individual circumstances and compliance with applicable laws.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMPLOYKIDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION: LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL; TAX PENALTIES OR ADDITIONAL TAXES OWED; IRS AUDIT OUTCOMES; DISALLOWED DEDUCTIONS OR CONTRIBUTIONS; OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO EMPLOYKIDS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless employkids and its owner, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any false, fraudulent, or misleading records you create using the Service
  • Any tax liability, penalty, or audit resulting from your use of the Service
  • Any claim that your use of the Service infringes the rights of a third party

13. Termination

By You: You may cancel your subscription and terminate your account at any time through your account settings or by contacting us. Upon cancellation, you will retain access until the end of your current billing period.

By Us: We may suspend or terminate your account immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or used the Service for illegal purposes.

Effect of Termination: Upon termination, your right to use the Service will immediately cease. We recommend exporting your data before termination. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

14. Dispute Resolution and Arbitration

Informal Resolution: Before filing any formal dispute, you agree to first contact us at hello@employkids.com to attempt to resolve the dispute informally. We will attempt to resolve any disputes within 30 days.

Binding Arbitration: If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall be conducted in English, and judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in California.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically. The "Last updated" date at the top of this page indicates when these Terms were last revised.

17. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and employkids regarding your use of the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
